Consultation on special guardianships

We consulted on a proposal to change our Special Guardianship Order Policy, which includes Child Arrangement Orders.


Special guardians have responsibility for day to day decisions relating to a child's care and upbringing, but have not adopted the child. A Special Guardianship Order (SGO) is an order of the court under the Children Act 1989 which grants the holder(s) parental responsibility over a child until they reach the age of 18

What was proposed?

We consulted on the proposals to:

  • adopt a new policy and procedures to ensure a consistent approach to the Special Guardianship Regulations, that set out open and transparent guidance for all people involved
  • offer special guardians access to a range of support and services
  • change the frequency of financial support payments for 'new' special guardians who do not require ongoing financial support from weekly to one-off' or instalment payments as agreed with the guardian. (The payments will continue to be based on age-related fostering allowance and payable up to two years as currently provided.
  • maintain regular payments if there is evidence of recurring expenditure
  • offer 'one-off' payments (not based on age-related fostering allowance) to meet an assessed need

What happened?

We consulted with possible/new and existing special guardians and the Relative Experience Project, which is representative charities supporting kinship carers and other interested parties.

The feedback we got helped us to decide any changes. The decision was made to make the changes that we had proposed including a change to the frequency of financial support payments flexible  one-off payments, and a new hourly rate of direct payment to new special guardians.
